A transaction contract that is not registered with the district court remains a legally binding contract. However, if one of the parties does not comply with the terms of the transaction agreement, the transaction contract must first be sued and a court decision must be obtained before coercive action can be taken against the defaulting party. For a transaction agreement to be applicable, it must be approved by the ABC Board of Directors by the order of the Board of Directors. After approval, the terms of the transaction agreement are attached to the ABC license and remain in effect for the duration of the licence, unless they are amended or terminated. If the license is sold, the new owners are bound by the terms of the transaction agreement. Parties to a transaction agreement can amend, terminate or enter into a new joint agreement at any time. When the parties reach a new agreement, they should state unequivocally that the agreement replaces the parties` previous agreements. The procedure for authorising the aforementioned contract applies. All transaction agreements approved by the ABC Board are published online. Requests for termination are first reviewed by the General Counsel`s ABRA office to verify the legal status in relation to the steps described above. If it is determined that the application is in compliance with the standards, the CBA Board of Directors will continue to review the application and make the decision to post the application. Any application that does not meet the above standards is not approved by the ABC card for display. Any party to a transaction agreement can request registration. The application must be submitted within four weeks of the date the transaction agreement was signed by all parties to the transaction agreement. In addition, ABC licenses that must be reported on site will be listed when a taker has entered into a transaction agreement. Agreements must be kept in the premises granted and made available upon request. Transaction agreements resulting from a contentious dispute must be concluded by aBRA no later than the day before the scheduled hearing, if the parties wish to be excused by that hearing. Although an ABRA lawyer is not in a position to provide a draft contract in a satisfactory manner, the parties may contact the legal department to determine whether a specific clause is enforceable.
